  • “Service Provider”, “we”, “us”, “our” refers to ATTAIN EUROPE Aneta Jarecka.

2. Scope of this document

These Terms of Service govern your use of the Website and its free features, including the Eligibility Check.

By accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy and Cookie Policy.

Important distinctions:

These Terms of Service also set out the general framework applicable to Professional Services offered by Attain Europe. However, the specific scope, fees, timeline, and conditions of Professional Services for each Client are determined individually in the Service Proposal. In the event of any inconsistency between these Terms of Service and the Service Proposal, the Service Proposal shall prevail.

The content published on the Website, including blog articles, service descriptions, and educational materials, is provided for general informational purposes only. It does not constitute legal advice, a binding offer within the meaning of Article 66 of the Polish Civil Code, or a guarantee of any particular outcome in citizenship or administrative proceedings.

Each case is treated individually. The scope of services applicable to a specific Client depends on their personal circumstances and will be outlined in the Service Proposal.

3. Eligibility Check

Attain Europe offers a free Eligibility Check, available through a form on the Website. The purpose of the Eligibility Check is to provide a preliminary, non-binding assessment of whether the User may qualify for the procedure of confirmation of Polish citizenship by descent.

What the Eligibility Check includes:

A review of the information submitted by the User through the online form, a preliminary assessment of potential eligibility, identification of possible risks, and a general outline of recommended next steps. The User will receive a written response by email.

What the Eligibility Check does not include:

A detailed analysis of individual documents, a review of a completed application, or a guarantee of outcome. At this stage, it is not possible to foresee all circumstances that may only come to light during later stages of the process.

Important:

Submitting the Eligibility Check form does not create any obligation on either party. It does not constitute an application for services, a binding agreement, or a commitment by Attain Europe to accept the case. The Eligibility Check is provided as a free electronic service within the meaning of the Polish Act on Providing Services by Electronic Means (Ustawa o świadczeniu usług drogą elektroniczną).

For information on how the data submitted through the Eligibility Check form is processed, please refer to our Privacy Policy.

4. Professional Services – general framework

Attain Europe specialises in guiding international clients through Polish administrative procedures, with a primary focus on confirmation of Polish citizenship by descent. Depending on the Client’s individual circumstances, the scope of Professional Services may include one or more of the following:

Core service:

  • Confirmation of Polish citizenship by descent – full handling of the administrative procedure, from case analysis through application submission to obtaining the decision.

Supporting and standalone services:

  • Document search in Polish archives
  • Registration (transcription) of foreign civil records at Polish Civil Registry Offices
  • Recognition of foreign divorce decrees in Poland
  • Administrative name or surname changes
  • Corrections and supplements to Polish civil records
  • Apostille for Polish documents
  • Certificates and other administrative requests
  • In-person assistance during administrative visits in Krakow

Each case is treated individually. The specific combination of services, their scope, and the applicable fees are determined in the Service Proposal based on the Client’s personal and family situation.

Nature of services and possible outcomes

The Professional Services provided by Attain Europe constitute an obligation of means (best efforts), not an obligation of result. Attain Europe commits to performing its work with due diligence, professional expertise, and in accordance with applicable procedures. However, all administrative decisions are made solely by the competent Polish authorities (Voivodeship Offices, the Ministry of the Interior and Administration, Civil Registry Offices, or other institutions). Attain Europe has no influence over the content or timing of these decisions.

Citizenship confirmation procedure: At the conclusion of the citizenship confirmation procedure, the Client will receive either a decision confirming possession of Polish citizenship or a decision refusing to confirm Polish citizenship, issued by the competent Polish authority. A negative decision may result from circumstances beyond the control of Attain Europe or the Client, including but not limited to: the ancestor having renounced or been deprived of Polish citizenship before Polish authorities, the ancestor having declared allegiance to a foreign state before Polish or non-Polish authorities, the loss of Polish citizenship under bilateral or multilateral agreements concluded by Poland in the 20th century (particularly those restricting dual citizenship), the ancestor having served in a foreign military or held a public office in a foreign state during a period when such circumstances resulted in the loss of Polish citizenship under then-applicable law, changes in the applicable legal framework or its interpretation by Polish authorities during the course of the proceedings, or the authority’s own investigation revealing disqualifying facts not previously known to the Client or the Service Provider. Attain Europe is not responsible for the outcome of administrative proceedings. The Service Provider is responsible for conducting the case diligently, not for the decision that emerges from it.

Appeals: In case of a negative decision at first instance (Voivodeship Office), Attain Europe will prepare and submit an appeal to the second instance authority (the Ministry of the Interior and Administration) on the Client’s behalf, at no additional cost. If the second instance decision is also negative, the Client may choose to appeal to the Administrative Court in Warsaw (third instance). Court proceedings require legal representation by a licensed attorney under Polish law and are not included in the scope of Professional Services. This is always an additionally paid service, regardless of whether the service provider is a lawyer or not. Attain Europe can assist the Client in finding a suitable legal professional.

Document search: At the conclusion of a document search, the Client will receive either copies of the documents found regarding their Polish ancestors, or written responses from the archives confirming that no relevant records were located. Attain Europe is not responsible for the outcome of the search. Polish archives are not fully digitised, and some records may have been destroyed during wars or through the passage of time. The service commissioned and paid for is the conducting of the search itself, carried out with due diligence.

Additional archival fees: In some cases, Polish archives or other institutions may charge additional fees for conducting searches or issuing copies of documents. If such fees arise, Attain Europe will inform the Client of the expected cost before proceeding. The Client’s approval is required before any additional expense is incurred. These fees are separate from the service fee specified in the Service Proposal.

Accuracy of information provided by the Client: The Service Provider relies on the accuracy and completeness of information provided by the Client. If it becomes apparent that key details affecting the scope of work were incorrect or incomplete (e.g. incorrect places or dates of birth, undisclosed family circumstances), Attain Europe reserves the right to adjust the scope and fees of the service accordingly. Any such adjustment will be communicated to the Client and requires the Client’s acceptance before additional work is undertaken.

Handling and delivery of documents

Certain original documents submitted during the procedure may be retained by Polish authorities and will not be returned. In particular, foreign civil status documents submitted for transcription at a Civil Registry Office are kept in the office’s records. The Client is advised to obtain additional originals or certified duplicates before sending documents to Attain Europe or to Polish authorities.

The Client is recommended to send original documents to Attain Europe via a trackable delivery method, such as a courier service or registered post through a reliable postal operator. Attain Europe is not responsible for any loss or damage to documents during transit, whether inbound or outbound. Any claims related to shipping must be directed to the carrier.

Upon completion of the case, Attain Europe will send the Client all Polish documents obtained during the procedure (e.g. citizenship confirmation decision, Polish civil status certificates, administrative decisions). Documents may be issued by authorities in traditional paper form or with a qualified electronic signature. The cost of dispatching the final document package to the Client is included in the service fee, unless otherwise stated in the Service Proposal.

What Professional Services do not include

Unless separately agreed in the Service Proposal:

  • Obtaining foreign documents from the Client’s country of residence (the Client handles this independently, with guidance from Attain Europe)
  • Legal representation before courts or in proceedings where a licensed legal professional is required by Polish law
  • Passport applications (the Client handles this independently at a Polish consulate or Voivodeship Office; Attain Europe can provide guidance)

5. How we work together

From enquiry to engagement

Working with Attain Europe typically follows these steps:

  1. Eligibility Check – The User submits the free online form. Attain Europe reviews the information and responds with a preliminary assessment by email.
  2. Case profiling – If the User appears to qualify, Attain Europe may request additional information needed to prepare a tailored Service Proposal (e.g. number of family members applying, marital status, availability of documents). This step is free and does not create any obligation.
  3. Service Proposal – Based on the information gathered, Attain Europe prepares and sends the Client a personalised Service Proposal by email (PDF), specifying the scope of services, fees, payment schedule, and estimated timeline. The Service Proposal is valid for 30 days from the date of issue, unless otherwise stated.
  4. Acceptance and commencement – The Client accepts the Service Proposal by confirming acceptance by email and making the first instalment payment. The payment constitutes acceptance of both the Service Proposal and these Terms of Service. From this moment, a binding professional services agreement is in effect.

After acceptance

Following the first instalment payment, the Client will receive confirmation, instructions, and a request to provide the information and documents necessary to begin work on the case. This includes, among other things:

  • Full personal details of the Client (and family members, if applicable), required for the preparation of powers of attorney and applications
  • A copy of the Client’s passport (and passports of family members, if applicable)
  • A power of attorney prepared by Attain Europe, which must be signed by the Client in original ink and returned by post
  • Foreign civil status documents and any other documents applicable to the case

The Client is expected to provide the original signed power of attorney and other essential documents within a reasonable timeframe. If 90 days have passed since the first instalment payment and the Service Provider has not received the key documents necessary to proceed, and the Client has not communicated a justified reason for the delay, the Service Provider may terminate the agreement in accordance with Section 9.

Subsequent phases of work

Work on the case proceeds in phases. The second instalment is due before sworn translations are ordered and applications are filed. The third instalment is due upon issuance of the administrative decision, before the final document package is prepared and dispatched to the Client. The exact timing of each phase depends on the specifics of the case and will be communicated to the Client as the work progresses.

6. Client’s responsibilities

The Client acknowledges and agrees to the following obligations throughout the course of cooperation with Attain Europe:

Accuracy of information. The Client is responsible for providing truthful, accurate, and complete information at every stage of the process. Attain Europe relies on the information provided by the Client to assess eligibility, develop a case strategy, and prepare applications. If any information proves to be incorrect, incomplete, or misleading, this may result in delays, additional costs, a negative outcome, or the need to adjust the scope and fees of the service in accordance with Section 4.

Obtaining foreign documents. The Client is responsible for obtaining all required documents from their country of residence or any country outside Poland (e.g. birth certificates, marriage certificates, divorce decrees, naturalisation records). Attain Europe will provide guidance on what documents are needed, in what form, and for what purpose, but cannot guarantee the accuracy of procedural requirements in foreign jurisdictions. The Client is expected to cooperate actively and verify local requirements independently where needed.

Timely communication and cooperation. The Client is expected to respond to communications from Attain Europe within a reasonable timeframe and to provide requested documents and information without undue delay. Delays on the Client’s side may affect the overall timeline of the procedure and do not constitute grounds for a complaint against the Service Provider.

Power of attorney. The Client is required to sign the power of attorney document prepared by Attain Europe and return the original, hand-signed document by post. As a general rule, Polish authorities require original powers of attorney and do not accept scanned or digitally signed copies. Attain Europe cannot act on the Client’s behalf or proceed with applications until the signed power of attorney has been received in the required form. If alternative arrangements regarding the form of the power of attorney become available, they will be communicated and agreed upon individually in the Service Proposal or in subsequent correspondence.

Shipping of documents. The Client is strongly recommended to send all original documents to Attain Europe via a trackable delivery method, such as a courier service or registered post through a reliable postal operator. Documents should be appropriately protected against damage during transit. The choice of carrier and shipping method is the Client’s responsibility. Attain Europe is not responsible for any loss, delay, or damage to documents during shipping, whether inbound or outbound. Any claims related to transit must be directed to the carrier by the party who arranged the shipment.

Costs of foreign document procurement. All costs associated with obtaining documents in the Client’s country of residence (e.g. fees for issuing certificates, apostilles, notarisations, shipping) are borne by the Client and are not included in the fees charged by Attain Europe, unless explicitly stated in the Service Proposal.

7. Fees, payments and billing

General pricing principles. All fees are determined individually for each Client and specified in the Service Proposal. The information provided on the Website regarding services and their general scope does not constitute a binding price offer.

Currency. All fees are quoted in USD, unless a different currency (EUR, GBP, or PLN) has been agreed in the Service Proposal. If the Client wishes to receive a quotation in a currency other than USD, this should be communicated during the case profiling stage.

Payment schedule. The fee for the core citizenship confirmation service is payable in three instalments, following the actual stages of the work:

  • 1st instalment: due upon acceptance of the Service Proposal (covers onboarding, case analysis, strategy development, preparation of powers of attorney and procedural documents)
  • 2nd instalment: due before sworn translations are ordered and applications are filed (covers document verification, translations, application preparation and submission)
  • 3rd instalment: due upon issuance of the administrative decision, before the final document package is prepared and dispatched to the Client (covers case monitoring, correspondence with authorities, collection and preparation of the final package)

For standalone services (e.g. document search, transcription, divorce recognition, Case Audit), payment is due in full before the work begins, unless otherwise agreed in the Service Proposal.

Payment methods. Payments can be made by bank transfer to the account specified in the Service Proposal or by credit or debit card. Attain Europe works with established payment service providers, including Stripe, Wise, and PayPal, to ensure secure and convenient transactions for international clients. The most suitable payment method for each Client will be discussed and confirmed during the engagement process.

Transaction costs. All bank charges, currency conversion fees, international transfer fees, and any other transaction-related costs are borne by the Client. The full amount specified in the Service Proposal must reach Attain Europe’s account. If the received amount is lower than the invoiced amount due to deductions by the Client’s bank or payment provider, the Client will be asked to cover the difference.

VAT and pricing transparency. Attain Europe is registered for VAT within the European Union. For Clients outside the EU, the price stated in the Service Proposal is the final price and no additional VAT is applied. For Clients within the EU, the total amount may be adjusted to include VAT depending on the Client’s tax residency, and where applicable, VAT will be specified separately in the invoice. In all cases, the Service Proposal will clearly state the final amount due, so the Client always knows the exact cost before making a payment. There are no hidden fees or charges beyond what is expressly stated in the Service Proposal.

Invoicing. Invoices are issued electronically and sent to the Client’s email address. Each instalment is invoiced separately upon receipt of payment. The Client will be asked to provide billing details (name and address) during the case profiling stage.

8. Right of withdrawal

14-day withdrawal right. The Client who is a consumer within the meaning of applicable law has the right to withdraw from the agreement without giving any reason within 14 days from the date of its conclusion. The agreement is considered concluded on the date the first instalment payment is made.

How to withdraw. To exercise the right of withdrawal, the Client must inform Attain Europe by sending a clear statement by email to hello@attaineurope.com. The Client may, but is not required to, use the withdrawal form available on the Website. No specific format is required – a simple email stating the intention to withdraw is sufficient.

Effects of withdrawal. If the Client withdraws within the 14-day period and has not consented to early commencement of services (see below), Attain Europe will refund all payments received from the Client within 14 days of receiving the withdrawal notice. The refund will be made using the same payment method as the original transaction. If either party wishes to use an alternative refund method, this requires the express agreement of both parties. Any original documents already sent by the Client will be returned within 14 days of withdrawal. The cost of return shipping is borne by the Client.

Consent to early commencement of services. The nature of the services provided by Attain Europe means that work on the Client’s case typically begins promptly after the first instalment is received (case analysis, strategy development, preparation of documents). The Client may expressly request that Attain Europe begins performing the agreed services before the expiry of the 14-day withdrawal period. This consent is provided as part of the Service Proposal acceptance process. If the Client has given such consent and subsequently withdraws before the service is fully performed, the Client is required to pay for the value of services already provided up to the moment of withdrawal. The corresponding amount will be deducted from the refund. If the services have been fully performed within the 14-day period, the right of withdrawal no longer applies, in accordance with Article 38(1) of the Polish Consumer Rights Act (Ustawa o prawach konsumenta).

9. Termination and refund policy

Termination by the Client. The Client may terminate the agreement at any time by sending a written notice by email to hello@attaineurope.com. Termination does not release the Client from the obligation to pay for work already performed and costs already incurred up to the date of termination.

Refund principles. Each instalment corresponds to a specific phase of work. The following principles apply in the event of termination by the Client:

If the Client terminates within the 14-day withdrawal period and has not consented to early commencement of services, a full refund is issued in accordance with Section 8. If the Client has consented to early commencement, the refund is reduced by the value of services already provided.

If the Client terminates after the 14-day withdrawal period (or after having waived it), the instalment corresponding to the current or completed phase of work is not refundable, as it constitutes remuneration for work performed. This includes, but is not limited to, case analysis, strategy development, preparation of powers of attorney, provision of instructions and guidance, preparation of applications, ordering of translations, correspondence with authorities, and any other activities undertaken within the scope of the relevant phase. Any instalment paid for a phase that has not yet commenced will be refunded in full, less any non-recoverable transaction fees (such as payment processor charges) incurred by Attain Europe. Refunds are processed within 30 days of receiving the termination notice.

Termination by the Service Provider. Attain Europe may terminate the agreement if the Client fails to provide essential documents (including the signed power of attorney) within 90 days of the first instalment payment without communicating a justified reason for the delay, if the Client provides information that is materially false or misleading making it impossible or unreasonably difficult to proceed, if the Client repeatedly fails to respond to communications or cooperate despite reminders, or if the Client engages in abusive, threatening, or harassing behaviour toward the Service Provider. In the event of termination by the Service Provider, the refund principles described above apply accordingly. The instalment corresponding to work already performed is retained, and any instalment paid for a phase not yet commenced is refunded.

Revocation of power of attorney. The Client has the right to revoke the power of attorney at any time. Revocation during pending administrative proceedings effectively prevents Attain Europe from continuing to manage the case on the Client’s behalf and is treated as termination of the agreement by the Client. The refund principles described above apply. The final document package, including any documents obtained during the procedure, is dispatched to the Client only after all outstanding payments corresponding to work already performed have been received.

Return of documents after termination. Upon termination, Attain Europe will return to the Client, within 30 days and at the Client’s expense, all original documents provided by the Client that are in Attain Europe’s possession and have not been submitted to Polish authorities. Documents already submitted to authorities are part of official proceedings and cannot be retrieved by Attain Europe. The Client may contact the relevant institution directly regarding such documents.

10. Chargeback protection and dispute resolution policy

Direct resolution first. If the Client is dissatisfied with any aspect of the services provided, the Client is requested to contact Attain Europe directly at hello@attaineurope.com before initiating any payment dispute, chargeback, or claim with a bank, credit card company, or payment provider. Attain Europe is committed to resolving any concerns promptly and in good faith.

Chargebacks. A chargeback is a reversal of a payment initiated by the Client through their bank or payment provider, bypassing direct communication with the Service Provider. Attain Europe recognises that chargebacks serve an important consumer protection function in cases of genuine fraud or unauthorised transactions. However, if a Client initiates a chargeback for a payment that was legitimately made for services that were or are being provided in accordance with the agreement, Attain Europe will defend the transaction through the representment process by submitting relevant evidence, including the accepted Service Proposal, email correspondence, proof of work performed, and these Terms of Service. In such cases, Attain Europe may also immediately suspend all work on the Client’s case and, where applicable, revoke powers of attorney granted before Polish authorities. The Client may be held liable for any administrative fees or penalties imposed on Attain Europe by the payment processor as a result of an unjustified chargeback. Attain Europe reserves the right to pursue recovery of amounts owed through appropriate legal channels. Clients are encouraged to communicate any concerns directly, as most issues can be resolved through dialogue without the need for formal dispute procedures.

11. Limitation of liability

Attain Europe performs all Professional Services with due diligence and professional care. However, certain aspects of the process are beyond the Service Provider’s control, and the following limitations apply.

Attain Europe is not liable for decisions, actions, or omissions of Polish administrative authorities, courts, civil registry offices, archives, or any other public institutions involved in the Client’s case. This includes, but is not limited to, the content of administrative decisions, processing times, requests for additional documentation, changes in institutional practices, and any errors or delays attributable to such institutions.

Attain Europe is not liable for changes in Polish law, regulations, or their interpretation by authorities that occur during the course of the proceedings and affect the outcome or timeline of the Client’s case.

Attain Europe is not liable for delays or complications resulting from inaccurate, incomplete, or misleading information provided by the Client, or from the Client’s failure to provide documents or cooperation in a timely manner.

Attain Europe is not liable for the content of documents found during archival searches or obtained from Polish institutions. Such documents may contain information previously unknown to the Client or the Service Provider that is unfavourable to the case.

Attain Europe is not liable for any loss, damage, or delay to documents during shipping, whether inbound or outbound. Responsibility for choosing a reliable delivery method and pursuing any claims with the carrier rests with the party who arranged the shipment.

Attain Europe is not liable for any failure or delay in performing its obligations under these Terms or any Service Proposal if such failure or delay is due to events of Force Majeure. This includes, but is not limited to, natural disasters, epidemics, war, civil unrest, acts of terrorism, or nationwide telecommunications or infrastructure failures.

To the extent permitted by applicable law, the total aggregate liability of Attain Europe arising out of or in connection with the agreement shall not exceed the total amount of fees actually paid by the Client to Attain Europe under the relevant Service Proposal.

Nothing in these Terms of Service excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intentional misconduct or gross negligence.

12. Intellectual property

All content published on the Website, including but not limited to text, articles, graphics, photographs, logos, page layouts, and downloadable materials, is the property of Attain Europe or is used with the permission of the rights holder and is protected by applicable copyright and intellectual property laws.

Users may view, download, and print content from the Website for personal, non-commercial use only. Any reproduction, distribution, modification, or public display of the content without the prior written consent of Attain Europe is prohibited.

The Attain Europe name, logo, and visual identity are proprietary to ATTAIN EUROPE Aneta Jarecka and are protected under applicable intellectual property and unfair competition laws. Use of these elements without prior written consent is not permitted.

13. Governing law and dispute resolution

These Terms of Service and any agreements concluded on their basis are governed by the laws of the Republic of Poland. However, in accordance with Article 6(2) of Regulation (EC) No 593/2008 (Rome I), the choice of Polish law does not deprive the Client who is a consumer of the protection afforded by the mandatory provisions of the law of the country in which the Client has their habitual residence.

Attain Europe encourages the amicable resolution of any disputes. If a disagreement arises, the Client is invited to contact Attain Europe at hello@attaineurope.com to seek a resolution before initiating formal proceedings.

For Clients who are consumers habitually resident in the European Union, information on the European Commission’s Online Dispute Resolution (ODR) platform is available at: https://ec.europa.eu/consumers/odr/. This platform may be used to submit a complaint regarding services purchased online.

If amicable resolution is not possible, disputes shall be submitted to the court of competent jurisdiction determined in accordance with applicable law.

14. Website use and technical requirements

Technical requirements. To access and use the Website, including browsing content and submitting forms, the User needs a device with a stable internet connection, a modern web browser with cookies and scripting enabled, and a valid email address for communication purposes.

Acceptable use. The User agrees not to use the Website in any way that could damage, disable, or impair its functionality, or interfere with other users’ access. Any attempt to gain unauthorised access to the Website, its servers, or connected systems is prohibited.

Complaints regarding the Website. If the User encounters any technical issues with the Website, they may submit a complaint by email to hello@attaineurope.com, including a brief description of the problem. Attain Europe will review the complaint and respond within 14 days.

Electronic service agreement. Accessing and using the Website constitutes entering into an agreement for the provision of electronic services within the meaning of the Polish Act on Providing Services by Electronic Means (Ustawa o świadczeniu usług drogą elektroniczną). This agreement is concluded for an indefinite period and is terminated when the User ceases to use the Website. The User may also request formal confirmation of termination by sending an email to hello@attaineurope.com.

15. Changes to these Terms and final provisions

Changes. Attain Europe reserves the right to update or modify these Terms of Service at any time. The date of the most recent update is indicated at the top of this document. Changes do not affect the terms of Service Proposals already accepted by Clients prior to the date of the change. For ongoing service agreements, the version of the Terms of Service in effect at the time of the Client’s acceptance of the Service Proposal applies, unless the Client expressly agrees to updated terms. Previous versions of this document are available upon request.

Severability. If any provision of these Terms of Service is found to be invalid, unlawful, or unenforceable by a competent court, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced, to the extent possible, by a valid provision that most closely reflects the original intent.

Entire agreement. These Terms of Service, together with the Privacy Policy, Cookie Policy, and the individual Service Proposal accepted by the Client, constitute the entire agreement between the parties regarding the subject matter hereof. In the event of any inconsistency, the Service Proposal shall prevail over these Terms of Service.
